1. Acceptance of Terms
The customer acknowledges having read the specific terms of sale at the time of placing the order and expressly declares their unconditional acceptance.
These general terms of sale govern the contractual relationship between TISSAYA SAS and its customer, both parties accepting them without reservation. These terms take precedence over any other conditions appearing in any other document, unless expressly agreed otherwise in writing. The customer may keep a copy of the Terms of Sale for record-keeping purposes.
2. Products
The products offered are those listed on the website. Photographs and illustrations are for reference only; slight differences in color or size may occur depending on the screen and production batch.
3. Orders
Automated recording systems are considered proof of the nature, content, and date of the order. TISSAYA SAS confirms acceptance of the order by email sent to the address provided by the customer. The sale is only concluded upon confirmation of the order. TISSAYA SAS reserves the right to cancel any order from a customer with an unresolved payment dispute for a previous order. Information provided by the buyer when placing the order is binding: in case of incorrect recipient details, the seller cannot be held responsible for any delivery failure.
4. Delivery
After order confirmation, TISSAYA SAS undertakes to deliver all ordered items to its carrier within a maximum of 7 business days. The carrier is contractually obliged to deliver the order to the address provided by TISSAYA SAS. Delivery times are indicative. Force majeure events (weather, natural disasters, strikes, logistical incidents, etc.) may cause delays.
In case of apparent defects, the buyer has the right to return the product under the conditions outlined herein.
Force majeure events relieving the seller of delivery obligations include war, riots, fire, strikes, accidents, and supply impossibilities. Always check your package upon arrival. You have 48 hours to report missing or damaged items to the carrier.
For availability reasons, an order may be delivered in multiple shipments, with only one delivery charged. If the customer wants multiple delivery locations, they must place multiple orders with the corresponding shipping fees.
5. Withdrawal
You have 30 days from receipt of the items to decide. For exchanges or refunds, return the item(s) in their original, intact packaging(1), including any accessories, to:
TISSAYA
Customer Service
4 Rue Gutenberg, 45500 Gien - France
If the withdrawal is exercised within the first 14 days, TISSAYA must refund the amounts paid by the customer, excluding return shipping costs. The refund is due within a maximum of 30 days. In other cases, a credit note will be offered. However, the legal right of withdrawal does not apply to opened hygiene or protective items (e.g., alternative masks, face shields) for health and safety reasons.
(1) The pouch directly enclosing the item.
6. Prices
Prices are expressed in euros.
The product price does not include shipping.
The price in the order confirmation is final, including all taxes (VAT for France). It includes the product price, handling, packaging, storage, shipping, and setup costs.
7. Payment
The price charged is the one indicated in the order confirmation from TISSAYA SAS.
Payment is due immediately on the day of the effective order.
Payment is made by credit card (CB logo) via Crédit Agricole’s secure banking server. Your card number is sent directly to the bank, not passing through the store server, ensuring security. The order is effective only upon approval by the bank. If the bank refuses, the order is automatically canceled, and the customer is notified by email. TISSAYA SAS reserves the right to refuse any order from a customer with an unresolved dispute.
Payment via PayPal is also possible, subject to PayPal’s terms.
8. Disputes
This contract is governed by French law. TISSAYA SAS is not responsible for any material, immaterial, or bodily damages resulting from misuse or malfunction of the products, including changes made by the manufacturers. Liability is limited to the order amount. Buyers are encouraged to seek an amicable solution first, through professional associations, consumer organizations, or other advisors. Seeking an amicable solution does not interrupt legal warranty periods or contractual guarantee duration. Generally, contractual guarantees are subject to the buyer fulfilling financial obligations to the seller.
Complaints are always received in good faith. Customers are advised to contact the company first to resolve disputes amicably.
The European Commission provides an online dispute resolution platform at http://ec.europa.eu/consumers/odr/. Customers with unsatisfied complaints are encouraged to contact us first at tissaya@orange.fr before filing a complaint via the EU platform. Toutacoo prioritizes customer satisfaction and applies high standards in handling concerns.
9. Warranty
TISSAYA SAS cannot be held responsible for non-compliance with regulations in the receiving country. Liability is limited to the product’s sale value at the time of purchase, without recourse to the brand or manufacturer.
10. Personal Data and Legal Information
Providing personal information is mandatory for processing and delivering orders, invoicing, and warranties. Failure to provide information prevents order validation.
Under the GDPR and French Data Protection Act, customers have rights of access, correction, deletion, objection, and data portability. These can be exercised via email at tissaya@orange.fr or by mail to TISSAYA SAS, 4 Rue Gutenberg, 45500 Gien, France.
Data is used solely for order processing, customer relationship management, and legal/accounting obligations. It may be shared with service providers (carriers, payment processors, technical providers) solely to fulfill the contract.
TISSAYA SAS commits not to share, sell, or transfer customer data except as legally required or with explicit consent.
Customers may opt in to receive marketing communications; this consent can be revoked at any time via unsubscribe links or by contacting Customer Service.
Data is retained for a limited time, proportional to its purpose and legal obligations (e.g., 10 years for accounting documents).
TISSAYA SAS implements appropriate technical and organizational security measures. In case of a high-risk data breach, customers will be notified according to applicable laws.
